Refusal to Waive Attorney-Client Privilege and Allow Former Paralegal to Testify

In a cause of action by a construction worker against the property owner, the jury was entitled to draw an adverse inference from the worker's refusal to waive his attorney-client privilege and allow a former paralegal at law firm that had represented him in his worker's compensation claim to testify for the property owner. Ramirez v. Willow Ridge Country Club, Inc. 922 N.Y.S.2d 343 (N.Y.A.D. 1 Dept.,2011).
